PREAMBLE

The present terms exclusively govern the sale of sweets, and by-products offered on the www.nicebonbon.com web site by the SA SiC-Confiserie.

The Terms of Use are permanently accessible and apply to all sales made to private individuals, hereafter referred to as "the customer", via the www.nicebonbon.com web site.

The customer accepts that e-mail is the preferred method of communication for commercial purposes.

Any order placed via the web site implies unreserved acceptance of the present terms of use. Orders will not be accepted in the event of disagreement with these terms.

The SiC-Confiserie company reserves the right to cancel or refuse any orders from customers with whom a dispute in relation to payment exists for a previous order.

ARTICLE 1 - ESTABLISHMENT OF THE CONTRACT

After consulting information relating to the characteristics of a product (or products) corresponding to his/her requests via the information pages available on the www.nicebonbon.com web site, the customer accepts the offer of sale made by the SiC-Confiserie company.

After reading and accepting the terms of use, the order is sent electronically by means of an order form, specifying the quantities and selection of each product. The sending of this form implies full and complete acceptance of the terms of use.

According to the method of payment chosen, the customer is directed to the secure system of credit card payment, or to the home page.

The customer receives an invoice by e-mail validating his order. The customer number will be indicated on this e-mail.

ARTICLE 2 - PRICES

The prices of our products are indicated in Euros. Prices include all taxes but do not include delivery costs.

All orders must be paid for in Euros.

The SiC-Confiserie company reserves the right to modify its prices at any time. In the event of a price modification, products will be invoiced on the basis of the price in force when the order was registered, subject to availability on this date.

ARTICLE 3 - AVAILABILITY

Our products and prices are valid as advertised on our web site, according to availability of stock.

ARTICLE 4 - METHOD OF PAYMENT

Payment can be made by cheque, or by credit card via the secure payment system in place on the web site.

Please note that payment by cheque may slow down the dispatch of an order, pursuant to article 6 of the present terms of use.

ARTICLE 5 - RESERVATION OF TITLE

All products remain the property of the SiC-Confiserie company until full payment has been received.

ARTICLE 6 - DELIVERY

Orders are dispatched once full payment of the price set for an order has been received.

The customer is informed by e-mail of the date when his order is dispatched. The order will be processed within 3 days of the date of receipt of payment

The SiC-Confiserie company essentially works with Colissimo Suivi. As soon as we are processing a delivery, we will immediately receive an e-mail.

ARTICLE 7 – DELIVERY ERROR

7.a. The consumer must express to the SiC-Confiserie company on the day of delivery or later than the first business day after delivery, any claim of error of delivery and / or non-conformity of goods in kind or in quality compared to entries on the order form. Any claim made after this time will be rejected.

7.b. The claim can be express to the the SiC-Confiserie company by the following: - primarily by phone 04 93 79 10 11 from Tuesday to Saturday from 9am to 12pm. - By connecting to our website in the "follow your delivery " where, after entering your customer number, you can ask your question through the web site.

7.c. Claims which weren't made in the rules defined above and within the time limits won't be taken into account and release any responsability of the society SiC-Confiserie towards the consumer.

7.d.When we receive a complaint, the SiC-Confiserie company assign a number of exchange of the concerned product and will communicat it by e-mail, fax or telephone to the consumers. The product exchange can only begin after the allocation of an exchange number to the consumer, according to the process above.

7.e. In case of a delivery's error or an exchange any product for exchange or refund should be returned to SiC-Confiserie company as a whole and in its original packaging, in Colissimo at the following address:

ARTICLE 8 - CANCELLATION OF ORDERS

Any order for which the chosen method of payment is by cheque and which has not been paid for within fifteen days of the order being placed, will be automatically cancelled by the SiC-Confiserie company

ARTICLE 9 - CUSTOMER LIABILITY

It is the customer's responsibility to:

-provide all necessary information for the efficient delivery of the order (full postal address and telephone details) when the order is placed

-to indicate the way of payment (by credit card thanks to the web site; www.nicebonbon.com, or by cheque; the order will only take place, after the reception of the cheque.

-verify that the products delivered match the products ordered within one day after the delivery.

ARTICLE 10 - LIABILITY OF LES ANIS DE FLAVIGNY

All products offered comply with French legislation in force and standards applicable in France.In the event of non-compliance with specific precautions of use in relation to the product, the SiC-Confiserie company will decline any responsibility for damages which may arise.

In case of events leading to a halt or reduction in the manufacture or transport of goods, or preventing the standard sales process, the SiC-Confiserie company will be relieved of all responsibilities, without notice.

ARTICLE 11 - APPLICABLE LAW

French law is applicable to the present contract, which was originally written in French. In case of dispute or claim, the consumer should first try to contact the SiC-Confiserie company in order to reach a friendly solution. Then in case of appeal, the consumer may file a claim through its dedicated dialog.

ARTICLE 12 – DATA PROTECTION

The requested information from the consumer are required in order the process the order. Those may be communicated to partners of the company involved Confectionery-SiC through the execution of this order. Consumers can write to the SiC-Confiserie company to oppose such disclosure, to exercise their access rights, or to correct his information as provided by the law of 6 January 1978.
